COVID-19 DISCLAIMER AND RELEASE

Before we finalize arrangements for your trip, we require you to acknowledge and agree to the following terms and conditions by signing below or clicking “I Agree” on our website.

Your acknowledgment confirms your agreement to these terms and conditions:
 

1. Health and Safety Risks:

  • You acknowledge that traveling is a personal decision made with full awareness of current travel advisories, restrictions, and risks associated with COVID-19.

  • The Boarding Pass assumes no responsibility or liability for unsafe conditions, health hazards, pandemics, or illnesses, including COVID-19, at any destination.

  • We do not possess specific knowledge of local dangers or health risks. For updated travel advisories, we recommend visiting the following resources:

2. COVID-19 Requirements and Rules:

  • The Boarding Pass is not responsible for government or travel supplier requirements related to COVID-19, such as vaccinations, health declarations, screenings, face coverings, or quarantine measures.

  • Rules and regulations are subject to frequent changes. Travelers should regularly check official government and travel supplier websites for updates, including:

3. Financial Responsibility of Travel Suppliers:

  • The Boarding Pass is not responsible for the actions, omissions, or financial instability of travel suppliers, including failure to provide services, refunds, or adhere to schedules.

  • We are not liable for recommending trip credits in lieu of refunds or for suppliers failing to honor future credits.

4. Rebooking and Refunds:

  • Upon request, we can assist with obtaining refunds or rebooking trips using future credits. However, this service incurs a nonrefundable fee, which will be communicated before services are rendered.

5. Travel Insurance:

  • We strongly recommend purchasing trip cancellation and travel insurance for your protection.

    • Note: Most standard policies exclude coverage for epidemics and pandemics unless a Cancel for Any Reason (CFAR) policy is purchased.

    • No representation made by The Boarding Pass constitutes a guarantee or assurance regarding coverage.

  • You agree to hold The Boarding Pass harmless for electing not to purchase travel insurance or for any denied claims related to COVID-19 or other issues.

6. Release of Liability:

  • You expressly assume all risks outlined in Sections 1–3, including health hazards, financial instability of suppliers, and changes to travel rules.

  • You hereby release, discharge, and hold harmless The Boarding Pass, its agents, employees, officers, directors, affiliates, group leaders, and subcontractors from any liability, claims, or legal actions arising from or related to these risks.

7. Claims Deadline and Jurisdiction:

  • Any claims against The Boarding Pass must be presented within 30 days after the trip’s conclusion and filed within one year of the incident, overriding the standard statute of limitations.

  • You agree that legal jurisdiction for claims is exclusively within [County Name], [State Name], and submit to the personal jurisdiction of those courts.

If you decline, you will be asked to sign a separate form confirming that you have chosen not to purchase insurance or that you have arranged your own cancellation and travel accident insurance.
